These terms cover the Locomotive Geek publishing tool ("the tool") and this website. Locomotive Geek is the owner and operator of both.
1. What this is
The tool is a private utility. It uploads Locomotive Geek's own videos to Locomotive Geek's own YouTube channel, sets their details and thumbnails, and replies to comments on them.
It is not a product and it is not offered to the public. There is no sign up, there are no accounts, and no one other than Locomotive Geek can use it or authorise it against their own YouTube account.
2. Agreement to the YouTube Terms of Service
The tool is an API Client of the YouTube Data API. By using the tool, you are agreeing to be bound by the YouTube Terms of Service, available at https://www.youtube.com/t/terms.
Your use of YouTube itself, and of any data obtained through the YouTube API, is governed by those terms. Information handled by Google and YouTube is governed by the Google Privacy Policy at http://www.google.com/policies/privacy.
3. Privacy
What the tool accesses, stores and uses is set out in the Privacy Policy, which forms part of these terms.
4. Acceptable use
Because the tool is private and single user, there is no general permission to use it. Do not attempt to access, copy, decompile, interfere with or gain authorisation to the tool or to the Locomotive Geek YouTube account.
5. Channel content
Videos published on the Locomotive Geek channel, including their scripts, narration, editing and thumbnails, remain the property of Locomotive Geek unless stated otherwise in the video or its description.
Archive photographs and film used in the videos remain the property of their own copyright holders and are credited in each video's description with the licence they were used under. If you hold rights in material used in a video and believe it has been used wrongly, email the address in section 9 and it will be dealt with promptly.
6. No warranty
The tool and this website are provided "as is", with no warranty of any kind, express or implied. Locomotive Geek does not warrant that the tool will be available, error free, or fit for any particular purpose.
7. Limitation of liability
To the fullest extent permitted by law, Locomotive Geek is not liable for any indirect, incidental, special or consequential loss arising out of the tool or this website, including loss of data, revenue or profits.
Nothing in these terms limits any liability that cannot lawfully be limited.
8. Changes and termination
These terms may change. Any change will be published on this page with a new "last updated" date. The tool may be changed or withdrawn at any time without notice, as it serves only Locomotive Geek.
